LEGAL GUARANTEE
The products offered by IM IMPORT & EXPORT, are covered by the legal guarantee of 1 year, from the delivery in the new products / services by the seller, in accordance with the provisions of the internal regulations. The legal guarantee of the products sold by IM IMPORT & EXPORT, is offered by IM IMPORT & EXPORT. The legal guarantee of products sold by external sellers is offered by external sellers.
WHAT IS THE LEGAL GUARANTEE?
It is the guarantee on the sale of consumer goods established by the European Directive 1999/44 / EC, also known as the "guarantee of conformity", which protects you when the products purchased are not in accordance with the contract of sale. This happens, for example, in those cases in which the products do not work correctly from the beginning, when they cannot be used in accordance with the services described by the seller or are not suitable for the uses to which products of the same type are ordinarily destined. , when they do not conform to the description or do not possess the qualities assured by the seller, or, when they are not suitable for the use for which they are intended.
AGAINST WHOM CAN I EXECUTE THE LEGAL GUARANTEE?
If you are a consumer, you have the right to demand the legal guarantee from the seller of the product, even if it is not the manufacturer.
WHAT RIGHTS DO I HAVE UNDER THE LEGAL GUARANTEE?
If the product you have purchased has a defect covered by the legal guarantee, you have the right to demand from the seller the repair or replacement of the defective product, free of charge. You are entitled to a price reduction or termination of the contract in the following cases: (a) if repair or replacement is not possible or excessively expensive; (b) if the seller does not repair or replace the product within a reasonable time; or (c) if the repair or replacement causes you significant inconvenience. Please keep in mind that a minor defect that prevents repair or replacement, or makes them very expensive, does not entitle you to terminate the contract.
WHAT IS THE DIFFERENCE BETWEEN THE LEGAL GUARANTEE AND COMMERCIAL GUARANTEES?
Normally, commercial guarantees cover the malfunction not present at the time of delivery, due to the use of the product, while the legal guarantee of conformity covers the malfunction caused by defects existing at the time of product delivery.
The legal guarantee is mandatory and is regulated by the General Law for the Defense of Consumers and Users, and the commercial guarantee depends on each store or company that sells products and services, and is additional to the legal guarantee, it cannot be inferior.
It is important to know that these two guarantees come into play, when the one who buys is a natural person and the one who sells is a company, they do not apply in the case of sales between companies or between individuals.
